Members of the commission: Comrades Andreev, Stalin, Molotov, Kaganovich L. M., Voroshilov, Kalinin, Yezhov, Shkiriatov, Krupskaia, Kosior, Yaroslavsky, Zhdanov, Khrushchev, Ulianova, Manuilsky, Litvinov, Yakir, Kabakov, Beria, Mirzoyan, Eikhe, Bagirov, Ikramov, Vareikis, Budenny, Yakovlev, Chubar, Kosarev, Postyshev, Petrovsky, Nikolaeva, Shvernik, Ugarov, Antipov, Gamarnik.

Discussion: of the suggestions of members of the commission.

The proposal of 1. Comrade Yezhov—to expel Bukharin and Rykov as candidate members of the Central Committee and members of the VKP(b) and to transfer them to the military tribunal with application of the highest measure of punishment—shooting.

THE SUGGESTIONS OF MEMBERS OF THE COMMISSION:

1. 2.> Postyshev—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), to transfer them to court without application of the death penalty.

2. 3.> Budenny—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), to transfer them to court with application of the death penalty.

3. 4.> Stalin—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), not to send them to court but rather to exile them. transfer their case to the NKVD.

4. 5.> Manuilsky—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), to transfer them to court with application of the death penalty.

5. Shkiriatov—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), to transfer them to court without application of the death penalty.

6. Antipov—same as above.

7. Khrushchev—same as above.

8. Nikolaeva—same as above.

9. Ulianova—for the suggestion of Comrade Stalin.

10. Shvernik—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), to transfer them to court with application of the death penalty.

11. Kosior—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), to transfer them to court without application of the death penalty.

12. Petrovsky—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), to transfer them to court without application of the death penalty.

13. Litvinov—same as above.

14. Krupskaia—for the suggestion of Comrade Stalin.

15. Kosarev—to expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), to transfer them to court with application of the death penalty.

16. Yakir—same as above.

17. Vareikis—for the suggestion of Comrade Stalin.

18. Molotov—for the suggestion of Comrade Stalin.

19. Voroshilov—for the suggestion of Comrade Stalin.

DECISION:

1. To expel from the ranks of candidate members of the Central Committee and as members of the VKP(b), not to send them to court but rather transfer them to the NKVD transfer the case of Bukharin and Rykov to the NKVD (adopted unanimously). 2. To instruct a commission composed of Comrades Stalin, Molotov, Voroshilov, Kaganovich, Mikoyan, and Yezhov to work out on the basis of this decision an acceptable resolution. [Signed] A.
